1. Agreement to Terms
By accessing or using WebGenie ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you must stop using the Service immediately.
These terms constitute a legally binding agreement between you and WebGenie ("we", "us", "our").
2. Description of Service
WebGenie is an AI-powered website generation tool that allows users to create websites by providing text prompts. The Service uses third-party AI models to generate HTML, CSS, and JavaScript code.
We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice.
3. Eligibility
You must be at least 18 years old to use WebGenie. By using the Service, you confirm that you meet this requirement. We do not knowingly collect data from users under 18.
WebGenie is currently only available to customers located in the United Kingdom. Account creation and paid subscriptions are restricted accordingly. We plan to expand availability internationally in future.
4. Accounts
You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account.
You must provide accurate and complete information when creating an account. We reserve the right to suspend or terminate accounts that contain false information.
5. Payments and Subscriptions
WebGenie has two paid products: a one-time payment to download a specific generated site, and a monthly subscription to unlock editing across your sites. By purchasing either, you authorise us to charge your payment method — once for the one-time purchase, or automatically each billing cycle for the subscription.
All prices are displayed in GBP (£). Prices may change with 30 days' notice.
You may cancel the editing subscription at any time; cancellation takes effect at the end of the current billing period and does not affect any site you've already purchased. The one-time site purchase has nothing ongoing to cancel. Please see our Refund Policy for details on refunds.
6. Acceptable Use
You agree not to use WebGenie to generate websites or content that:
- Is illegal under UK law or the law of your jurisdiction
- Infringes any third-party intellectual property rights
- Is defamatory, harassing, or abusive
- Contains malware, phishing, or deceptive content
- Promotes violence, terrorism, or self-harm
- Violates our full Acceptable Use Policy
Violation of these rules may result in immediate account termination without refund.
7. Intellectual Property
You own the websites you generate using WebGenie. We do not claim ownership over output generated by the Service.
You grant us a limited licence to process your prompts solely to provide the Service. We do not store or use your prompts to train AI models.
WebGenie's branding, logo, and platform code remain our intellectual property.
8. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind. We do not guarantee that generated websites will be error-free, suitable for your specific purpose, or free from third-party intellectual property issues.
You are responsible for reviewing and testing any content generated by the AI before publishing it.
9. Limitation of Liability
To the maximum extent permitted by UK law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
Our total liability to you for any claim shall not exceed the amount you paid us in the 30 days preceding the claim.
10. Cooling-Off Period & Your Cancellation Rights
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel a purchase within 14 days without giving a reason (your "cooling-off period").
Editing subscription: You may cancel within 14 days of subscribing for a full refund, provided you have not yet used the editing feature. If you begin editing a site during the cooling-off period, you expressly request that we start performing the service immediately and acknowledge that your right to cancel is lost once you have done so.
One-time site download: By completing the purchase and downloading your site, you expressly request immediate access to the digital content and acknowledge that your right to cancel is lost once the download has begun, in accordance with Regulation 37 of the Consumer Contracts Regulations 2013.
To cancel within the cooling-off period before using the service, contact us at webgenie16@gmail.com. Refunds will be issued within 14 days to your original payment method.
12. Termination
We reserve the right to suspend or terminate your account at any time if you breach these Terms. You may close your account at any time by contacting us.
Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law.
13. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
